Terms of Service.
Please read these terms carefully before using ToolFluency.
1. Acceptance of Terms
By accessing or using ToolFluency ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all users, including visitors who use only the free tools and registered account holders.
2. Description of Service
ToolFluency is a web-based platform offering free browser tools, a paid Business Suite, Personal finance tools, Games, a Kids Zone, and 3D Assets. The Service is provided by a sole proprietor operating from Ontario, Canada.
3. Account Registration
Certain features require a registered account. You agree to provide accurate information during registration and to keep your credentials secure. You are responsible for all activity under your account. You must be at least 13 years old to create an account.
4. Subscription & Billing
Paid plans are billed in Canadian dollars (CAD) and processed securely via Stripe. The following plans are currently offered:
- Personal Plus — $5/mo (monthly) or $48/yr (annual, ~$4/mo)
- Business — $16/mo (monthly) or $156/yr (annual, ~$13/mo)
- Business Pro — $32/mo (monthly) or $312/yr (annual, ~$26/mo)
Subscriptions renew automatically at the end of each billing period (monthly or annual) until cancelled. Cancellation takes effect at the end of the current billing period; access continues until that date. Annual plans are billed as a single charge once per year. Business and Business Pro plans include a free trial measured in client-facing actions, not calendar days: 10 actions for Business, 15 actions for Business Pro. A "client-facing action" is sending an invoice, estimate, contract, or receipt; committing a payroll run; generating a tax or P&L report; or sending an employee invite. Setting up your business (clients, expenses, employees, inventory, catalog, jobs, vehicles, mileage) is unlimited and does not count against the trial. No credit card is required to start the trial. After the trial actions are used, you may subscribe to continue or your account drops to the free tier with all setup data preserved. We offer a 30-day money-back guarantee on paid subscriptions. Annual subscriptions are otherwise non-refundable after 30 days except where required by applicable law. Prices are subject to change with notice to registered users.
5. Acceptable Use
You agree not to: reverse engineer, copy, or redistribute any part of the Service; use automated tools to scrape or abuse the platform; attempt to access systems or data you are not authorised to access; use the Service for any unlawful purpose; or impersonate any person or entity.
6. Intellectual Property
All content, code, design, and branding within ToolFluency is the intellectual property of its creator. You may not reproduce, distribute, or create derivative works without explicit written permission. User-generated content (such as saved documents) remains your property.
7. Privacy
Your use of the Service is also governed by our Privacy Policy. Free tool data is processed entirely client-side and never transmitted to our servers. Paid account data is stored securely as described in the Privacy Policy.
8. Kids Zone — COPPA Compliance
The Kids Zone is designed for use by children and their families. No advertising is displayed in the Kids Zone under any circumstances. We operate the Kids Zone in two distinct modes, each with different data-collection implications:
Mode A — Anonymous use: The Kids Zone tools are freely accessible without an account or sign-in. In this mode, no personal information is collected, no behaviour is tracked, and no data is transmitted to our servers. Anyone — child or adult — can use the interactive learning tools without creating an account.
Mode B — Family plan child accounts: Subscribers on the Family plan may create child profiles within their account. Account creation is performed entirely by the parent or guardian; the parent's act of creating the child account on the child's behalf constitutes verifiable parental consent as required by the Children's Online Privacy Protection Act (COPPA) and applicable Canadian privacy law (PIPEDA). Once a child account exists, the child signs in using a Kid Code (a picture passcode) — no email address or personal information is required from the child directly. We collect the following data for each child account: the child's display name, Kid Code hash, learning-progression data (XP points, subject mastery scores, activity completion history), session duration, streak counts, and daily screen-time records. This data is stored under the parent's account in Firestore, is used solely to display progress reports and parental controls within the parent's dashboard, is never used for advertising or sold to third parties, and is deleted when the parent removes the child profile or closes their account. Parents or guardians who believe a child's data has been collected without proper consent should contact us at hello@toolfluency.com for immediate deletion.
9. Games & 3D Assets
Games are provided for personal entertainment. 3D assets available for download are licensed under a royalty-free licence for both personal and commercial use. Attribution is not required. You may not redistribute the assets as a standalone collection or claim them as your own original work.
10. Work Suite — Employer-Employee Relationship
The Work Suite is a tool to help employers manage timesheets, scheduling, and payroll calculations. ToolFluency is not a party to any employer-employee relationship. All payroll calculations are provided for informational purposes. You are responsible for verifying compliance with applicable employment standards legislation in your jurisdiction.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that calculations are suitable for professional financial, legal, or tax advice. Always consult a qualified professional for important decisions.
12. Limitation of Liability
To the fullest extent permitted by law, ToolFluency shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.
13. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.
14. Changes to Terms
We may update these Terms from time to time. We will notify registered users of material changes by email or prominent notice within the platform. Continued use after changes constitutes acceptance of the new terms.
